Welcome to The Forged Legion (“we,” “us,” “our”). We operate this online store and website, powered by Shopify, to provide a personalized shopping experience for limited-run collectible figurines (the “Services”). 1 – ACCESS & ACCOUNT
You represent you’re of majority age in your jurisdiction and authorize minors in your care to use the Services on devices you control. Provide accurate, current, and complete information. You’re responsible for safeguarding account credentials and all activity under your account. No transferring or sublicensing of accounts.
2 – PRODUCTS (LIMITED-RUN COLLECTIBLES)
We strive to present products accurately; colors/appearance may vary by device. Packaging matters to collectors; normal transit wear may occur. Descriptions, availability, and prices may change without notice. We may discontinue or limit quantities by person/region/jurisdiction.
3 – ORDERS
Your order is an offer; we may accept/refuse at our discretion. Acceptance occurs upon confirmation and payment processing. Review your order before submitting; cancellations may not be possible after acceptance. If we change/decline/cancel, we’ll try to notify you via your checkout contact details. Returns/exchanges follow our [Return & Refund Policy]. Purchases are for personal use not for resale/export. We may limit/cancel suspected reseller/bot orders.
Pre-orders: cancellable before shipment for a full refund; once shipped, standard returns apply. Limited supply is not guaranteed until acceptance.
4 – PRICING & BILLING
Prices/promos may change without notice. Charged price is the price at order time and appears in the confirmation email. Prices exclude taxes, shipping/handling, and (if international) duties/import fees unless stated otherwise. You agree to provide and promptly update accurate billing and payment details, warrant authorization to use the method, and pay all charges, taxes, and shipping.
5 – PAYMENTS, FRAUD & CHARGEBACKS
(a) Fraud prevention. We may use third-party tools, manual review, or request additional verification to prevent fraud or abuse.
(b) Disputes/chargebacks. To prevent duplicate refunds and abuse, we do not process returns or refunds while an order is the subject of a payment dispute, chargeback, or retrieval request with a card issuer or PayPal. If you wish to return an item, any dispute must be fully withdrawn or closed first.
(c) Outcome. If a dispute is closed in our favor, no refund will be issued on that order (change-of-mind returns are ineligible). At our discretion, we may offer store credit only. If a dispute is decided in your favor by the payment provider, no additional refund will be issued by us.
(d) Statutory rights. Nothing in this Section limits any non-waivable statutory rights you may have regarding defective, damaged, or misdescribed goods, which are handled under our standard defect/warranty procedures.
6 – SHIPPING & DELIVERY
Timelines are estimates, not guarantees. We’re not responsible for carrier/customs delays or events beyond our control. Title and risk of loss transfer to you when items are handed to the carrier. Signature may be required for high-value orders; incorrect addresses may cause delays/returns and reship fees.
Delivery times are estimates and not guaranteed.
Delays caused by carriers or seasonal demand (including holidays) do not qualify as a refund reason.
7 – INTELLECTUAL PROPERTY
All content and materials on the Services are owned by The Forged Legion or licensors and protected by IP laws. Personal, non-commercial use only unless we consent in writing. Our names/logos are trademarks of The Forged Legion; Shopify’s are trademarks of Shopify; others belong to their owners.
8 – OPTIONAL TOOLS
Access to third-party tools is provided “as-is/as-available” without warranties. Use is at your risk and may be subject to third-party terms. New features/resources are also subject to these Terms.
9 – THIRD-PARTY LINKS
We’re not responsible for third-party content, sites, products, or services. Review third-party policies before transactions. Direct concerns to the third party.
10 – RELATIONSHIP WITH SHOPIFY
Our store runs on Shopify, but sales are by The Forged Legion. Shopify isn’t responsible for your purchases. You expressly release Shopify and affiliates from claims arising from your transactions with The Forged Legion.
11 – PRIVACY
Personal data collected through the Services is governed by our [Privacy Policy] and, in part, by Shopify’s privacy policy. Data you submit may be processed by Shopify and providers in other countries to operate/improve the Services.
12 – FEEDBACK & USER CONTENT
By submitting ideas/reviews/suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose. You represent you own/control rights in the Feedback and that it complies with law and these Terms. We may moderate content at our discretion.
13 – ERRORS & OMISSIONS
We may correct errors/inaccuracies and update information or cancel orders if information is inaccurate, at any time and without notice (including after order submission).
14 – PROHIBITED USES
You agree not to use the Services unlawfully; to infringe IP; to harass/abuse/defame; to transmit false/misleading content; to spam or distribute malware; to scrape/harvest personal data; or to bypass security. We may suspend/terminate for violations.
15 – TERMINATION
We may terminate access at any time without notice; you remain liable for amounts due through termination. Sections that should survive will do so (e.g., IP, Feedback, Disclaimers, Liability Limits, Indemnity, Severability, Waiver/Entire Agreement, Assignment, Governing Law).
16 – DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and all products are provided “as-is” and “as available” without warranties (express/implied), including merchantability, fitness, title, and non-infringement. We don’t warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions don’t allow certain disclaimers; those may not apply.
17 – LIMITATION OF LIABILITY
To the fullest extent permitted, The Forged Legion (and our affiliates, staff, contractors, providers, licensors) and Shopify and its affiliates are not liable for indirect, incidental, punitive, special, or consequential damages (including lost profits/revenue/savings, data loss, replacement costs) arising from use of the Services/products, whether in contract, tort, strict liability, or otherwise—even if advised of the possibility. Where liability cannot be disclaimed, our aggregate liability will not exceed the amount you paid for the product(s) at issue.
18 – INDEMNIFICATION
You will indemnify/defend/hold harmless The Forged Legion, Shopify, and affiliates against third-party claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or law, or your use of the Services/products. We may control the defense at your expense; you’ll cooperate.
19 – SEVERABILITY
If any provision is unlawful/void/unenforceable, it will be enforced to the maximum extent permitted; the remainder remains in effect.
20 – WAIVER; ENTIRE AGREEMENT
No waiver by us is continuing or of any other term. These Terms and posted policies constitute the entire agreement and supersede prior communications.
21 – ASSIGNMENT
You may not assign or delegate these Terms without our prior written consent. We may assign without notice.
22 – GOVERNING LAW
